MINUTES: (In Chambers) Order GRANTING in part and DENYING in part Defendants motions to dismiss 23 24 . Thus, based on the foregoing, Defendants motions are: (1) GRANTED with respect to Plaintiffs fifth cause of action for supervisory liability; ( 2) DENIED with respect to Plaintiffs sixth and seventh causes of action for municipal liability under Monell and City of Canton; (3)GRANTED with respect to Plaintiffs eighth cause of action for violation of due process; (4) DENIED with respect to Pla intiffs twelfth and thirteenth causes of action for violation of California civil rights statutes against City Defendants; and (5) GRANTED with respect to Plaintiffs eleventh through eighteenth causes of action for state law violations against CountyDefendants. Plaintiffs have until February 28, 2011 to amend the pleadings in accordance with this Order. Failure to do so will result in dismissal of the claims with prejudice IT IS SO ORDERED by Judge Philip S. Gutierrez. (ir)
