Diaz (“Diaz”) and defendant 21 Dinayra Serpa (“Serpa”) and as otherwise agreed to in writing by the parties, hereby 22 ADJUDGES that final judgment, including a permanent injunction, shall be and hereby is 23 entered on the Complaint in this action insofar as it pertains to Serpa. The terms of the 24 permanent injunction are as follows: 25 A. 26 Permanent Injunction Serpa, her agents, representatives, and all other persons, firms or entities acting in 27 concert or participating with her, including without limitation Antonio Brache, are 28 permanently enjoined and restrained from directly or indirectly engaging in, or _____________________________________________________1_______________________________________________________ FINAL JUDGMENT AND PERMANENT INJUNCTION AGAINST DEFENDANT DINAYRA SERPA 1 authorizing or assisting any third party to engage in, any of the following activities in the 2 United States and throughout the world: 3 1. 4 Registration Number 3.231.554, the Certificate of Registration for which is 5 attached as Exhibit 1. 6 2. 7 advertising, promoting or otherwise dealing in any girdles, shapewear or other 8 apparel that bears, or is otherwise associated with, the mark FÁJATE or any 9 colorable imitation thereof supplied by Marlene Prada Bautista or supplied by Infringing Diaz's FAJATE mark, United States Patent and Trademark Office Packaging, buying, selling, reselling, importing, exporting, shipping, 10 anyone else other than Diaz. 11 3. 12 manufacture any girdles, shapewear or other goods in connection with the 13 FÁJATE mark or any colorable imitation thereof. 14 4. 15 manufacture any labels, tags or the like that bear the FÁJATE mark or any 16 colorable imitation thereof. 17 5. 18 FÁJATE mark or any colorable imitation thereof supplied by Marlene Prada 19 Bautista or supplied by anyone else other than Diaz. 20 6. 21 control, including without limitation www.girdlesandclothing.com, any and all 22 references, whether such references appear on goods or in text, to the FÁJATE 23 mark or any colorable imitation thereof wherein such reference is for goods 24 supplied by Marlene Prada Bautista or supplied by anyone else other than Diaz. 25 7. 26 to Diaz’s use of, registration of, and/or any rights in, Diaz’s FAJATE mark and/or 27 any variations thereof, including, without limitation, challenging the validity or 28 enforceability thereof.
