1 2 3 4 5 6 7 8 UNITED STATES DISTRICT COURT 9 CENTRAL DISTRICT OF CALIFORNIA 10 11 BRADLEY WOJNO, Plaintiff, 12 13 Case No.: CV10-7238 JAK (JEM) JUDGMENT JS-6 v. 14 CIGNA GROUP INSURANCE, a corporation; SALOMON SMITH 15 BARNEY LONG TERM DISABILITY PLAN, an ERISA plan; ROES 1 16 through 10, inclusive, Defendants. 17 18 19 This matter having come to trial, and the Court having considered the written 20 and oral argument of the Parties, the Court orders that Judgment be entered as 21 follows: 22 Defendants Cigna Life Insurance Company of New York and the Salomon 23 Smith Barney Long Term Disability Plan shall reinstate Plaintiff Bradley Wojno 24 into active benefit payment status in the Plan retroactive to September 3, 2008, the 25 date his active participation in the Plan and monthly benefit payments were 26 terminated. Likewise, and to the extent they have not already done so, Defendants 27 shall pay to Plaintiff monthly disability benefits from September 3, 2008 to the 28 present, and shall continue to pay such benefits to Plaintiff so long as he is eligible 1 to receive those benefits under the terms of the Plan. Defendants shall pay to 2 Plaintiff pre-judgment interest in the amount to which they have agreed. 3 Based on his reinstatement to active payment status in the Plan, Plaintiff shall 4 be eligible for other Plan benefits for which other disabled Plan participants are 5 eligible, if any, subject to the terms and conditions of the Plan and any other benefit 6 plans referenced therein. 7 Finally, Plaintiff is awarded attorneys fees and costs in the amount agreed to 8 by the parties. 9 10 Date: December 18, 2013 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The Hon.
