The matter before the Court is Defendants’ Motion to Dismiss Complaint for Lack of Subject
Matter Jurisdiction and Failure to State a Claim (“Motion to Dismis”), filed on January 24, 2011. [Doc.
No. 16.] On February 15, 2011, Plaintiffs filed a First Amended Complaint, which supersedes the
preceding complaint. See Forsyth v. Humana, Inc., 114 F.3d 1467, 1474 (9th Cir. 1997). [Doc. No.
21.] Defendants’ Motion to Dismiss is therefore DENIED as moot.
