STIPULATION REGARDING RESPONSE TO AMENDED COMPLAINT AND BRIEFING SCHEDULE

WHEREAS, the Plaintiffs’ filed their Second Amended Complaint on

2 October 24, 2011; and
3

WHEREAS, the parties enter into this stipulation for the purposes of

4 establishing a response date to the Second Amended Complaint and further to
5 establish a briefing schedule on Defendants’ anticipated motion to dismiss the
6 Second Amended Complaint;

NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED that

8 the deadline for Defendants’ response to the Second Amended Complaint and the
9 briefing schedule for any motion to dismiss be as follows:
10

1. Defendants’ response to Plaintiffs’ Second Amended Complaint

11 will be due no later than November 23, 2011.
12

2. In the event that Defendants choose to file a motion to dismiss,

13 Plaintiffs’ opposition brief will be due December 21, 2011.

3. Defendants’ reply brief will be due January 16, 2012.

4. The hearing on any such motion shall be February 6. 2012, at

16 11:00 a.m., or as soon thereafter as is practical for the Court
