Pursuant to the Court’s order of May 15, 2012 (Dkt. 111), the parties submit this

joint status report regarding the status of settlement.
On May 31, 2012, the parties filed a joint ex parte application to approve the

5

settlement agreement and dismiss this action under Fed. R. Civ. P. 41(a). (Dkt. 114.)

On June 1, 2012, Creditor Hendricks & Lewis filed an opposition to the ex parte

8

application. (Dkt. 115.) No opposition has been filed by Creditor Allan Law Group,

9

and the ex parte application remains pending with the Court.
Separately, Plaintiff intends to file under seal a “Motion for Distribution and

Division of Settlement Funds.” Plaintiff expects to file this motion by Friday, June 8,

12

2012.

The parties are mindful that the Court has scheduled for August 13, 2012, a

14

hearing on the Court’s order to show cause why settlement has not been finalized.

15

(Dkt. 113.) If the Court grants the pending ex parte application and approves the

16

settlement, then the parties will be able to file a stipulation and proposed order for

17

dismissal.
