FINAL JUDGMENT AND PERMANENT INJUNCTION by Judge Gary A. Feess, in favor of Dish Network L.L.C. against James Terrazas. This permanent injunction takes effect immediately. Judgment is entered in favor of DISH Network on Count III of the complaint all eging violations of 18 U.S.C. §§ 2511(1)(a) and 2520. Statutory damages in the amount of $10,000 are awarded to DISH Network in accordance with 18 U.S.C. § 2520(c)(2)(B). Attorneys fees in the amount of $1,200 are awarded to DISH Network in accordance with 18 U.S.C. § 2520(b)(3) and L.R. 55-3. Counts I and II of the complaint are dismissed with prejudice. The Court retains jurisdiction over this action for a period of two years for the purpose of enforcing this final judgment and permanent injunction (MD JS-6, Case Terminated). (rrey)

On February 9, 2012, the Court granted the motion for default judgment filed
21
by Plaintiffs DISH Network L.L.C., EchoStar Technologies L.L.C., and NagraStar
22
LLC (collectively, “DISH Network”). (Docket No. 12.) The Court now enters this
23
final judgment and permanent injunction against Defendant James Terrazas and
24
orders as follows:

(1)

Defendant and anyone acting in active concert or participation with, or
at the direction or control of Defendant, is hereby permanently enjoined from:
A.
circumventing or assisting others in circumventing DISH
Network’s security system, or otherwise intercepting or assisting others in

intercepting DISH Network’s satellite signal;

B.
testing, analyzing, reverse engineering, manipulating, or
3
otherwise extracting codes, data, or information from DISH Network’s satellite
4
receivers, smart cards, satellite data stream, or any other part or component of the
5
DISH Network security system.

This permanent injunction takes effect immediately.

Judgment is entered in favor of DISH Network on Count III of the

complaint alleging violations of 18 U.S.C. §§ 2511(1)(a) and 2520.
