On July 19, 2012, Plaintiff FTR International,
19 Inc.’s (“Plaintiff”) Motion to Dismiss [8] came on for
20 regular calendar before the Court.
Having reviewed all
21 arguments and papers pertaining to this Motion, the
22 Court NOW FINDS AND RULES AS FOLLOWS:

The Court hereby GRANTS Plaintiff’s Motion to
24 Dismiss and DENIES Defendant BNP Associates, Inc.’s
25 (“Defendant”) request for attorney’s fees and costs.
26 The Court finds that Plaintiff meets the requirements
27 for voluntary dismissal under Federal Rule of Civil
28 Procedure 41(a)(2).
Moreover, the Court finds that

1 under both federal and California law, Defendant is not
2 entitled to attorney’s fees and costs upon voluntary
3 dismissal.
