“Petitioner”) filed a “Petition for Writ of Habeas Corpus under

28 U.S.C. § 2241" in the United States District Court for the

Central District of California.

Court
issued
a
Report
and

Recommendation of United States Magistrate Judge recommending

that the Petition be dismissed without prejudice. (See Docket

Nos. 3, 4.)

August
10,
2012,
the
Report
and
Recommendation

returned to the Court. The Court
