No. 1.) On March 13, 2014, the Court issued an order to show 21 cause why the case should not be dismissed for lack of 22 prosecution, as Plaintiff had failed to file proof of 23 service as to Defendant Casa Blanca Mortgage, Inc. within 24 120 days of removal. 25 4(m). (Doc. No. 23.) Fed. R. Civ. P. The Court put Plaintiffs on notice that failure to 26 respond to the order would be deemed consent to the 27 dismissal of the action. 28 (Id.) 1 As of the date of this Order, Plaintiffs have not 2 responded to the order to show cause, nor have they filed 3 proof of service as to Defendant. Plaintiffs have not 4 filed anything in this action since initiating the 5 Complaint. 6 As there are no remaining Defendants1, the Court 7 DISMISSES Plaintiffs’ Complaint WITHOUT PREJUDICE. 8 Clerk shall close the file.
