hereby submit this Joint Statement Regarding Settlement pursuant to Local Rules

16-2.9 and 16-15 and the Joint Scheduling Conference Report Pursuant to Rule

4

26(f) (Dkt. No. 21):

At the initial Rule 26 meet and confer in March 2013, the parties discussed an

6

early settlement conference or mediation to determine whether settlement without

7

further litigation was possible. The parties attended formal mediation before Judge

8

William J. Cahill (Ret.) on May 28, 2013. The parties did not reach a settlement

9

that day. The parties continued to mediate and discuss settlement in good faith, with

10

the assistance of Judge Cahill, until August 22, 2013. On August 22, 2013, the

11

parties decided to terminate the mediation effort.

On August 4, 2014, the parties agreed to renew mediation before Judge

13

Cahill. With the Court’s approval, the parties attended mediation on September 3,

14

2014. The parties did not reach a settlement that day, but agreed to continue

15

settlement discussion. On September 8, 2014, the parties terminated this second

16

attempt at settlement

At this time, the parties do not believe that any alternative dispute resolution
procedure would lead to a resolution of this matter.
