On June 6, 2013, the court issued an Order granting plaintiff leave to file a First Amended

Complaint no later than June 20, 2013. Plaintiff was “cautioned that failure to timely file a First
18
Amended Complaint may result in this action being dismissed without prejudice for failure to
19
prosecute and/or failure to comply with a court order. See Fed. R. Civ. P. 41(b); Link v. Wabash
20
R. Co., 370 U.S. 626, 629-30, 82 S.Ct. 1386, 1388 (1962).” As of the filing date of this Order, no
21
First Amended Complaint has been filed. Accordingly, IT IS ORDERED that the above-captioned
22
case is dismissed, without prejudice, for lack of prosecution and failure to comply with the orders
23
of the court. See Fed. R. Civ. P. 41(b).
