MINUTES (IN CHAMBERS) Order re: Application to File Unredacted Reply Brief Under Seal (Dkt. 365) by Judge George H. King granting 365 APPLICATION to Seal Document: We GRANT the request. Within ten days hereof, Plaintiffs SHALL state whether their response brief, (Dkt. 364), should be filed under seal and, if so, provide a redacted version of the brief to be filed publicly. Failing this, it shall be deemed Plaintiffs' position that Defendants' unredacted response and reply briefs regarding the billing records, (Dkts. 354, 366), need not be filed under seal. (Dkt. 366.) Because the billing records are filed under seal, Defendants request that we allow them to file an unredacted version of the reply under seal. (Dkt. 365.) We GRANT the request. Defendants submit, however, that there is “no good cause for [their] opening and reply briefs to remain under seal and publicly available only in redacted form,” given that Plaintiffs filed their response brief regarding the billing records in the public record. (See id. at 1-2.) Defendants contend that Plaintiffs’ decision to file their brief publicly shows that Plaintiffs “do not believe that quotes from, paraphrasing of, or analyses of the contents of the billing records are confidential.” (Id. at 1.) Within ten days hereof, Plaintiffs SHALL state whether their response brief, (Dkt. 364), should be filed under seal and, if so, provide a redacted version of the brief to be filed publicly.
