The Motion to Dismiss was set to be heard on 24 October 28, 2013. On October 25, 2013, the Court ordered that the hearing date be 25 vacated and considered the Motion to Dismiss on the papers submitted. 26 By Order dated October 25, 2013, the Court granted Travelers’ Motion to 27 Dismiss without prejudice.
