PLAINTIFF SHALL TAKE NOTHING AGAINST DEFENDANT BY WAY OF HIS COMPLAINT AND ALL OF PLAINTIFF'S CLAIMS AGAINST DEFENDANT AND THIS ENTIRE ACTION SHALL BE AND IS HEREBY DISMISSED WITH PREJUDICE.
