SUN AND RODNEY ) MILLAR, ) ) ) Claimants. ) 22 23 Plaintiff United States of America (the “government”) and 24 claimant Natalie S. Sun (“Claimant Sun”) have entered into a 25 stipulated request for the entry of this consent judgment of 26 forfeiture resolving all interests that Claimant Sun may have in 27 the defendant, namely, $45,357.00 in U.S. Currency. 28 1 This civil forfeiture action was commenced on December 30, 2 2015. 3 Claimant Sun filed a claim on March 29, 2016 and an answer on 4 April 11, 2016. 5 on July 6, 2016. 6 issued a Partial Consent Judgment as to $12,000 of the defendant 7 currency. 8 $8,400 (plus all interest accrued on that amount since seizure) 9 was forfeited to the government, and $3,600 (without interest) Notice was given and published according to law. Doc. ## 14 & 15. Doc. # 23. Doc. # 27. Rodney Millar filed a claim On September 7, 2016, this Court Pursuant to the Partial Consent Judgment, 10 was returned to Millar. 11 and the time for filing claims and answers has expired. No other claims or answers were filed, The Court has been duly advised of and has considered the 12 13 matter. Based upon the mutual consent of the parties hereto and 14 good cause appearing therefor, the Court hereby ORDERS, ADJUDGES 15 AND DECREES that $33,347.00 (the remainder of the defendant 16 currency) shall be returned to Claimant Sun without interest. 17 Said funds are to be made payable via ACH deposit. 18 shall provide the information necessary to facilitate such 19 payment according to law. Claimant Sun The Court finds that there was reasonable cause for the 20 21 seizure of the defendant currency and the institution of this 22 action. 23 certificate of reasonable cause pursuant to 28 U.S.C. § 2465. 24 /// This consent judgment shall be construed as a 25 26 27 28 2 1 Each of the parties shall bear its own fees and costs in 2 connection with the seizure, retention and return of the 3 defendant currency, and this action. 4 deadlines are VACATED.
