Fischer 1 2 The Parties having so stipulated and good cause appearing, the Court enters an Amended Judgement in accordance with the following terms. 3 AMENDED JUDGMENT 4 5 6 7 IT IS HEREBY ORDERED, ADJUDGED, AND DECREED: (1) incorporated herein by reference in its entirety; 8 9 The Judgement entered on September 25, 2017 (Dkt. #183) is (2) All claims against Defendants Firemall, LLC (“Firemall”) and Mitchel 10 Berkowitz 11 PREJUDICE; 12 (3) (“Berkowitz”) are hereby DISMISSED WITH Firemall, Berkowitz, and other entities in which Berkowitz retains any 13 ownership interest, either directly or through his family or agents are 14 permanently enjoined from infringing any of Plaintiffs Capbran 15 Holdings, LLC and Nutribullet, LLC’s (collectively referred to as 16 “Capbran”) trademarks, trade dress, copyrights, and design patents, 17 including but not limited to any future sales of counterfeit products of 18 Capbran or its related entities; and 19 (4) Each Party shall bear its own costs and attorneys’ fees. 20 21 IT IS SO ORDERED. 22 23 24 25 Dated: 3/6/18 Hon.
