Electronics, Inc. (now PNY 6 Technologies, Inc.) are hereby dismissed without prejudice. 7 All counterclaims asserted in this action between Counter Claimant PNY 8 Technologies, Inc. and Counter Defendant USB Technologies, LLC are hereby 9 dismissed without prejudice. 10 All attorneys’ fees and costs are to be borne by the party that incurred them. 11 It is further ORDERED that upon satisfaction of the relevant contingencies 12 contained in the Settlement Agreement between USB Technologies, LLC and PNY 13 Technologies, Inc., the parties shall file a Joint Motion to Amend this Order of 14 Dismissal Without Prejudice to convert the dismissal of all claims asserted against 15 Defendants to a dismissal with prejudice. 16 IT IS SO ORDERED. 17 18 DATED: February 22, 2017 19 By: 20 Honorable Beverly R.
