3 IT IS HEREBY ORDERED that the above-referenced action (including all of
4 Plaintiff’s Complaint and all of Defendant’s Counterclaims) be and hereby is
5 dismissed in its entirety, with prejudice. This dismissal is not intended to have any
6 preclusive effect on the claims asserted by XPO in the separate action entitled XPO
7 CNW, Inc., et al. v. R&L Carriers, Inc., et al., United States District Court for the
