See DKT. #31. The motion was scheduled for hearing on December 19, 2016. Id. Pursuant to Local Rule 7-9, 3 4 PLAINTIFF was required to oppose the motion by November 28, 2016. CL.R. 7- 5 9. PLAINTIFF did not file an opposition to the motion, timely or otherwise. 6 Thus, pursuant to the Local Rule 7-12, the Court deems PLAINTIFF’s failure to 7 8 file a timely opposition as consent to granting the motion. CL.R. 7-12. On 9 November 29, 2016, this Court entered its Order granting DEFENDANT’s 10 motion to dismiss PLAINTIFF’s First Amended Original Petition, with prejudice, 11 12 terminating the instant action.
