CONSENT DECREE AND ORDER by Judge John F. Walter. NOW THEREFORE IT IS HEREBY STIPULATED BETWEEN THE SETTLING PARTIES AND ORDERED AND DECREED BY THE COURT AS FOLLOWS: (1) The Court has jurisdiction over the subject matter of this action pursuant to Section 505(a)(1)(A) of the CWA, 33 USC 1365(a)(1)(A). (3) The complaint states a claim upon which relief may be granted against Defendant pursuant to Section 505 of the CWA, 33 USC 1365. (4) Waterkeeper has standing to bring this action. (5) The Court shall retain jurisdiction over this matter for purposes of interpreting, modifying or enforcing the terms of this consent Decree, or for as long thereafter as is necessary for the Court to resolve any motion to enforce this Consent Decree. (See attachment for further details). (41) Defendant agrees to make a payment of $20,000 within 30 days of the Effective Date to the rose Foundation for a project. (42) Defendant shall pay the $40,000 within 30 days of the Effective Date and shall be make payable to Law office of Gideon Kracov. (43) Defendant shall pay a total of $5,000 to compensate Waterkeeper for costs and fees to be incurred for monitoring Defendant compliance with this Consent Decree. (45) Defendant shall make a remediation payment of $600 for each missed deadline included in this Consent Decree. (SEE ATTACHMENT FOR FURTHER DETAILS). (MD JS-6. Case Terminated ) (jp)
