Having reviewed the Stipulation of the parties, and for good cause appearing
therefore, IT IS HEREBY ORDERED as follows:

That Metropolitan Life Insurance Company (“MetLife”) is discharged

of any and all liability with respect to the Plan Benefits and the underlying group
27
policy and any and all claims that Defendants-in-Interpleader Gicana and Maloney
28
may have regarding the Plan Benefits and the underlying group policy;

That Defendants-In-Interpleader Gicana and Maloney and their

MetLife and/or its parent companies, subsidiary companies, agents, affiliates,

representatives or attorneys with respect to the Plan Benefits and the underlying

group policy;

That MetLife will recover its attorneys’ fees and costs from the stake

on deposit in the amount of $4,068.7. Said funds are to be payable to Metropolitan

Life Insurance Company and sent to MetLife’s counsel of record Misty A. Murray,

That MetLife is dismissed from this action entirely with prejudice.
