WOOTEN CONSTRUCTION COMPANY, KENNETH WOOTEN, also known as KEN WOOTEN, and RAY WOOTEN, Defendants. 18 19 20 In accordance with the Court’s Order granting the Motion for Default Judgment filed 21 by plaintiffs Carpenters Southwest Administration Corporation and Board of Trustees for 22 the Carpenters Southwest Trusts (collectively “Plaintiffs”), 23 IT IS HEREBY ORDERED, ADJUDGED AND DECREED that: 24 1. 25 26 Plaintiffs shall have judgment entered in their favor against defendant Wooten Construction Company for: Unpaid contributions: 27 Liquidated damages based on 28 original contributions: $299,304.91 51,727.40 1 Interest on the unpaid 2 80.54 contributions pursuant to 29 3 U.S.C. § 1132(g)(2) (at 7% per 4 annum) and the Trust 5 Agreements from the due date 6 to the audit billing date: 7 Audit Fees: 8 Interest from audit billing date 9 to June 20, 2017 (accruing at 28.20 10 $67.68 per day): 11 Attorneys’ fees pursuant to 12 Local Rule 55-3: 13 Total: 29,097.40 14 15 16 17 18 19 20 2. 10,622.82 390,861.27 Plaintffs shall have judgment entered in their favor against defendants Kenneth Wooten, also known as Ken Wooten, and Ray Wooten for: Unpaid contributions: $29,022.22 Interest on the unpaid 1,617.78 contributions pursuant to 29 U.S.C. § 1132(g)(2) (at 7% per annum) and the Trust 21 Agreements from the due date 22 to June 20, 2017 (accruing at 23 5.57 per day): 24 Attorneys’ fees pursuant to 25 Local Rule 55-3: 26 Total: 2,341.33 32,981.33 27 28 -2- 1 3. Wooten Construction Company shall, for so long as it remains bound to make 2 payments or contributions to Plaintiffs, provide to Plaintiffs complete, truthful, 3 and accurate Employers Monthly Reports covering all employees of Wooten 4 Construction Company, employed during the previous month under the Master 5 Agreements between it and Plaintiffs; 6 4. Plaintiffs shall recover their costs of suit; and 7 5.
