Teaney and J. Black (“Defendants”) and the Opposition and Reply briefs relating thereto, and the Report and Recommendation of the assigned United States Magistrate Judge and the Objection thereto filed by Plaintiff. Further, the Court has engaged in a de novo review of those portions of the Report and Recommendation to which objections have been made. IT IS HEREBY ORDERED that: 1. The Report and Recommendation is approved and accepted; 2. The Motion to Dismiss (Dkt. No. 35) is GRANTED with leave to amend; and 1 2 3. If Plaintiff desires to continue to pursue this action, he shall file a 3 First Amended Complaint within 30 days of the date of this Order. 4 Plaintiff is advised that failure to timely file a First Amended 5 Complaint may result in a dismissal of this action with prejudice 6 for failure to prosecute. Plaintiff is further advised that a failure to 7 remedy the deficiencies identified in the Report and 8 Recommendation in any First Amended Complaint could result in 9 a dismissal of the action without leave to amend and with 10 11 12 13 prejudice.
