Order to Show Cause Re; Dismissal For Lack Of Prosecution
On June 1, 2017, the Court granted Plaintiff leave to file a First Amended Complaint by
no later than June 12, 2017. Plaintiff was further ordered to file proofs of service for any
defendants named in the First Amended Complaint by July 3, 2017.
In the present case, Plaintiff filed a First Amended Complaint on June 15, 2017, but has
not served Defendants Quality Loan Service Corporation and Wells Fargo Bank, National
Association.
Accordingly, the court, on its own motion, orders plaintiff to show cause in writing on or
before July 28, 2017 why defendants Quality Loan Service Corporation and Wells Fargo Bank,
National Association should not be dismissed for lack of prosecution. Pursuant to Rule 78 of the
Federal Rules of Civil Procedure, the court finds that this matter is appropriate for submission
without oral argument. The Order to Show Cause will stand submitted upon the filing of
plaintiff’s response. Failure to respond to this Order may result in the imposition of sanctions,
including but not limited to dismissal of the complaint.
