ORDER DISMISSING ACTION FOR LACK OF PROSECUTION by Judge R. Gary Klausner. On June 14, 2017, the Court issued an Order to Show Cause ("OSC") re Dismissal for Lack of Prosecution, requiring a response on or before June 19, 2017. On June 19 , 2017, Plaintiff's counsel filed a response stating that their attorney service is still in process of properly serving Defendant and believe that they will be in a position to file the Proof of Service within the "next two months." Additionally, counsel requested that the Court refrain from dismissing this action. On June 20, 2017, the Court issued an order extending Plaintiff's deadline to file the Proof of Service of Summons and Complaint by no later than July 11, 20 17. The order warned Plaintiff that failure to do so will result in immediate dismissal for lack of prosecution. As of today, the Proof of Service has been filed. Therefore, the Court orders the matter dismissed for lack of prosecution. 13 , 10 , 11 . Case Terminated. Made JS-6. (pso)
