JUDGMENT 14 CONEJO VALLEY UNIFIED SCHOOL DISTRICT, 15 Defendant. 16 17 18 19 Pursuant to the Court’s Memorandum Decision and Order, the Court enters judgment as follows: 20 21 Plaintiffs’ Motion is GRANTED IN PART and DENIED IN PART. The 22 Court reverses the portion of the ALJ’s Decision finding that the 23 April 2016 IEP offered Student a FAPE despite Defendant’s failure 24 to conduct a functional behavior assessment and the significant 25 impediment that failure posed to Parents’ meaningful participation 26 in the IEP process. 27 that Student should not be awarded any compensatory education one- 28 on-one aide services. The Court further reverses the ALJ’s finding Accordingly, the Court AWARDS Student an 1 increase in the compensatory education services granted by the ALJ 2 to include an additional: 3 a 4 language therapy from a District speech and language pathologist; 5 sixty minutes of behavior intervention services from a District 6 behaviorist; and fifty-two and a half hours of one-on-one aide 7 services. 8 the cost of Dr. Ott’s services is GRANTED. 9 remaining claims and requests are DENIED. credentialed District seven hours of individual counseling by counselor; seven hours of speech and Plaintiffs’ request for reimbursement of $700.00 for All of Plaintiffs’ Defendant shall make 10 arrangements for payment of Dr. Ott’s $700.00 fee to Plaintiffs 11 within thirty days of entry of this Judgment. 12 13 Any Motion for Attorney’s Fees and Costs shall be filed within 14 thirty dates of the date of this Judgment. 1 15 (providing discretion to court to set deadline for fee motion).
