The court has reviewed the plaintiff’s Amended Notice of Settlement (“Notice”), in which

plaintiff states the parties have settled plaintiff’s individual claim with prejudice and will seek to
18
dismiss the class claims without prejudice. (See Notice at 1).

Having reviewed the case file and determined that no prejudice to the class will result from
20
the dismissal, IT IS ORDERED that the above-captioned action is hereby dismissed with
21
prejudice as to plaintiff and without prejudice as to the class. The dismissal shall be without costs
22
and plaintiff shall retain the right, upon good cause shown within 30 days from the filing date of
23
this Order, to re-open the action if settlement is not consummated. The court retains full
24
