and the City of Hawthorne (hereinafter collectively “City Defendants”), and
Defendants Ronald Valdivia and the County of Los Angeles (“County Defendants”),
by and through their respective counsel of record, makes the following rulings
thereon:

1.
Any and all DOCUMENTS in Defendant County of Los Angeles’
2
possession, custody and/or control relating to the following shall be produced under
3
seal and subject to the confidentiality requirements set forth by this protective order
4
(“DOCUMENT” means a writing as defined by Federal Rules of Evidence 1001(1),
5
and shall include without limitation, the original (and absent the original then a copy
6
thereof), all file copies and copies not identical to the original of any writing or
7
record of every type, form, and description that is in the possession, custody, or
8
control of the responding party, or that no longer is in the responding party’s
9
possession but that the responding party still has knowledge, whether or not said
10
writings or records are claimed to be privileged or otherwise immune from discovery
11
including by way of illustration and not limitation, the following items, whether said
12
writings or records are on paper, magnetic disk, tape, or other computer or digital
13
storage medium, microfilm, microfiche, floppy, or any other storage or recording
14
medium):

a) Personnel file for Ronald Valdivia, including, but not limited to:
16
a. Any and all training documents for Ronald Valdivia, including
17
dates of training, descriptions of training and certificates of
18
completion;
19
b. Any and all salary information, including bonus verifications;
20
c. Any and all performance evaluations and related reports;
21
d. Any and all other personnel records contained within Ronald
22
Valdivia’s personnel file.

Any and all DOCUMENTS in Defendant City of Hawthorne’s
24
possession, custody and/or control relating to the following shall be produced under
25
seal and subject to the confidentiality requirements set forth by this protective order:
26
a) Personnel file for Keith Kauffman, including, but not limited to:
27
a. Any and all training documents for Keith Kauffman;

b. Any and all salary information;

IT IS FURTHER ORDERED THAT,

Any information produced by any party may be designated, pursuant to
6
this Protective Order, “CONFIDENTIAL INFORMATION,” by the Producing Party1
7
marking (apart from original deposition or trial transcripts) the words
8
“CONFIDENTIAL SUBJECT TO PROTECTIVE ORDER” on each page of such
9
designated material.

CONFIDENTIAL INFORMATION shall be used in this litigation as
a. CONFIDENTIAL INFORMATION and the information contained
13
therein shall be used solely in connection with this litigation and the
14
preparation of this case, or any related appellate proceeding, and not for
15
any other purpose, including any other litigation or administrative
16
proceedings. Further, the Parties’ Counsel agrees that
17
CONFIDENTIAL INFORMATION and the information contained
18
therein shall be for Attorney’s Eyes Only, and shall not be disclosed to
19
their clients.

b. Under no circumstances shall the CONFIDENTIAL INFORMATION,
21
or the information contained therein, be retained, compiled, stored, used
22
as a database, or disseminated, in any form, except for purposes of this
23
litigated matter in accordance with this Protective Order or by further
24
order of the Court;

c. The Producing Party reserves all objections, including but not limited to
26
the following objections: on grounds that particular documents are
27

For purposes of this Order, the “Producing Party” shall mean the party producing documents and/or seeking to
designate the material confidential. The “Receiving Party” shall mean any party receiving discovery material.

CONFIDENTIAL by the attorney-client and/or the attorney work
2
product doctrine; official information privilege; are not likely to lead to
3
the discovery of admissible evidence, and as such are not relevant to the
4
causes of action raised by this lawsuit under Federal Rules of Civil
5
Procedure, Rule 26(a)(1)(A)(B); and all remedies under the Federal
6
Rules of Civil Procedure and the Federal Rules of Evidence, including
7
the right to recess a deposition to bring a protective order before the
8
Court;
9
d. The parties reserve all rights and remedies under the Federal Rules of
10
Civil Procedure and the Federal Rules of Evidence pertaining to
11
discovery;
12
e. CONFIDENTIAL INFORMATION and the information contained
13
therein may not be disclosed, except as set forth in paragraph 2(f) below;
14
f. CONFIDENTIAL INFORMATION and the information contained
15
therein may only be disclosed to the following persons:
16
i. Counsel for the Receiving Party;
17
ii. Paralegal, law clerk, stenographic, clerical and secretarial
18
personnel regularly employed by counsel referred to in paragraph
19
2(f)(i) above;
20
iii. The Court, as set forth below;
21
iv. Any expert, consultant, or law student retained in the instant case
22
by the Receiving Party, provided that each such person sign a
23
Declaration of Compliance (in the form attached hereto as Exhibit
24
“A”) stating that he or she has read and understands the
25
Stipulation and Protective Order and agrees to be bound by its
26
terms. However, Plaintiff’s counsel may not disclose directly to
27
the Plaintiff, either orally or in writing, the names, addresses, and
28
telephone numbers of any information or witnesses identified in

the CONFIDENTIAL INFORMATION, but may discuss with the
2
Plaintiff the information obtained from any investigation
3
conducted as a result of disclosed CONFIDENTIAL
4
INFORMATION;
5
v. Any individual approved by the Court.
6
g. CONFIDENTIAL INFORMATION shall not be divulged to any other
7
person or entities, including but not limited to the print, radio, telephone,
8
world wide web or internet, or television media;
9
h. CONFIDENTIAL INFORMATION shall not be posted on the internet
10
or on any website;
11
i. If any information and/or documents which are the subject of this
12
Protective Order are presented to this or any other court in any other
13
manner prior to the time of trial, said information and/or documents
14
shall be lodged under seal, pursuant to Local Rule 79-5.1, and with an
15
appropriate application made to United States District Judge John F.
16
Walter, for lodging under seal, in an envelope clearly marked as follows:
17
“CONFIDENTIAL AND MATERIAL
18
SUBJECT TO A PROTECTIVE ORDER.
19
CASE NO. 2:17-cv-06576-DMG (PLAx).”

j. In the event that any of the CONFIDENTIAL INFORMATION is used
21
in any Court proceeding in this action and is sealed and does not appear
22
as part of the publicly accessible record, it shall not lose its confidential
23
status through such use, and the party using CONFIDENTIAL
24
INFORMATION shall take all reasonable steps to maintain its
25
confidentiality during such use; however, nothing in this provision limits
26
the parties from using such materials filed with the Court and part of the
27
publicly accessible record in any way;

k. Testimony taken at any deposition, conference, hearing, or trial may be
2
designated as confidential by making a statement to that effect on the
3
record at the deposition or proceeding. The party seeking to designate
4
the transcript as CONFIDENTIAL shall make arrangements with the
5
Court Reporter transcribing such proceedings to separately bind such
6
portions of the transcript containing information designated as
7
confidential, and to label such portions accordingly.
8
l. Nothing in this protective order should be interpreted as stipulating to or
9
requiring the closure of trial proceedings or the sealing of any evidence
10
at trial. To close or seal any trial proceedings, the party seeking closure
11
or sealing must apply to the Court in advance. To better allow such
12
applications, the parties agree to notify each other of their intent to use
13
material designated CONFIDENTIAL at trial, prior to trial for written
14
documents and exhibits, or prior to the use of any prior testimony used
15
for impeachment or admissions;

Edward Ortega, the Plaintiff in this case, may not under any
17
circumstances retain or view the following documents or be allowed to make or keep
18
any copies of such documents specified below. This provision shall apply to all
19
Plaintiffs in this case regardless of the status of the case and current counsel. These
20
categories of documents are specifically categorized as follows:
21
a) Personnel file for Ronald Valdivia, including, but not limited to:
22
a. Any and all training documents for Ronald Valdivia, including
23
dates of training, descriptions of training and certificates of
24
completion;
25
b. Any and all salary information, including bonus verifications;

c. Any and all performance evaluations and related reports;

Kauffman’s personnel file.

4.
Plaintiff, Plaintiff’s Counsel, County Defendants, County Defendants’
8
Counsel, City Defendants, and City Defendants’ Counsel shall cause the substance of
9
this Protective Order to be communicated and obtain agreement to abide by the
10
Protective Order to each person whom CONFIDENTIAL materials are revealed in
11
accordance with this Order.

5.
The Receiving Party may challenge the designation as
13
CONFIDENTIAL INFORMATION of any material so designated by a Producing
14
Party. The Receiving Party must raise a challenge to such designation, in writing, to
15
the Producing Party prior to the non-expert discovery cut off date. The parties must
16
meet and confer in an attempt to resolve any such challenge. Failing informal
17
resolution between parties, the Producing Party may file and serve a Motion for a
18
Protective Order with the Court, pursuant to Local Rule 37. The parties agree that if
19
the Motion for Protective Order is filed within 21 days of the written challenge
20
(subject to extension upon agreement of the Parties), the Material will retain its
21
original designation until the Court rules on the Motion for a Protective Order. If the
22
Producing Party does not file a motion within the 21-day period following a
23
challenge, the material is no longer designated as CONFIDENTIAL
24
INFORMATION for purposes of this Order, but that change in designation does not
25
bar the Producing Party from subsequently filing a motion for a protective order.

After completion of the judicial process in this case, including any
2
appeals or other termination of this litigation, all CONFIDENTIAL INFORMATION
3
received under the provisions of this Order and copies thereof shall be destroyed or
4
returned to the attorneys of record for the Producing Party. The provisions of this
5
Order shall be in effect until further order of this Court.
6
7.
That any counsel, expert or consultant retained in the instant case or
7
investigator retained by counsel for any party to this case, shall not disclose the
8
CONFIDENTIAL INFORMATION of the information contained therein in any other
9
court proceeding subject to further order of this Court.

8.
All CONFIDENTIAL INFORMATION produced in accordance with
11
this Protective Order shall not be used in any deposition, legal proceeding, or in any
12
other forum than the instant case, nor shall the CONFIDENTIAL INFORMATION
13
be disseminated in any form, except by court order, or until such time as the
14
“CONFIDENTIAL” designation is removed by agreement of counsel for the parties,
15
by operation of Paragraph 5 of this Order, or by further order of this Court.

9.
Provisions of this Order insofar as they restrict disclosure and the use of
material shall be in effect until further order of this Court.

10.
In the event that the terms of this Protective Order are violated, the
19
parties agree that the aggrieved party may immediately apply to the Federal Court to
20
obtain injunctive relief and monetary sanctions against any person violating or
21
threatening to violate any of the terms of this Protective Order. This Court shall
22
retain jurisdiction over the parties for the purpose of enforcing this Protective Order,
23
and the Court shall have the power to modify this Protective Order at any time and to

impose whatever penalties it deems appropriate for the violation of this Protective
2
Order, including but not limited to monetary sanctions, judicial sanctions, issue
3
preclusion, and contempt. Any such request for injunctive relief and/or monetary
4
sanctions must be made by a properly noticed motion and pursuant to statute to the
5
appropriate Court.
