Having 20 completed its review, the Court accepts the findings and recommendations set forth in the 21 Report. Accordingly, IT IS ORDERED that: (1) Defendant Black’s Motion to Dismiss is 22 GRANTED with prejudice; and (2) Judgment shall be entered dismissing the remainder of this 23 action without prejudice for Plaintiff’s failure to prosecute pursuant to Federal Rule of Civil 24 Procedure 41(b) and under Local Rules 7-12 and 41-6.
