MINUTES (IN CHAMBERS) ORDER DENYING PLAINTIFFS' MOTION FOR REMAND 16 by Judge Stephen V. Wilson. Plaintiffs' motion is DENIED because it fails to satisfy each of the three prongs of the local controversy exception requirements. Two of th ose failures could have been corrected through jurisdictional discovery (failure to prove that two-thirds of class members are California citizen) and an amended complaint (failure to allege local defendant's conduct was a significant basis for the claims asserted.) But the third failure- failure to allege that principal injuries were incurred in California- cannot be corrected because the conduct at issue occurred nationwide. The Court therefore DENIES Plaintiffs' request for leave to conduct jurisdictional discovery and Plaintiffs' request for leave to amend their complaint to address the local controversy requirements. Plaintiffs may petition the Court for leave to amend their complaint for other reasons. (SEE DOCUMENT FOR FURTHER DETAILS.) (rolm)
