Plaintiff Elizabeth Sarah Zapler accepted Defendant Ford Motor Company’s

22

Offer of Judgment Pursuant to Fed. R. Civ. P. 68 on May 17, 2024. Per the terms of

23

the Rule 68 offer, Ford has agreed to pay Plaintiff and their current counsel of record

24

the sum of $65,000.00 in restitution and includes a provision allowing Plaintiff to seek

25

an award of reasonable attorneys’ fees, expenses, and costs, if any, reasonably

26

incurred in connection with this action in an amount to be determined by the Court.

Ford expressly reserves all defenses to any fee or cost motion and any award thereon.
