On November 15, 2012 Plaintiffs James Wayne Palmer,
19 Jr. and Susan Darlene Palmer (collectively, "Plaintiffs")
20 filed a first amended complaint against Deutsche Bank
21 National Trust Company (“Deutsche Bank”), as Trustee for
22 the Registered Holders of Morgan Stanley ABS Capital I
23 Inc. Trust 2007-NC3 Mortgage Pass-Through Certificates,
24 Series 2007-NC3 (“Morgan Stanley”), Mortgage Electronic
25 Registration Systems, Inc. (“MERS”), Ocwen Loan
26 Servicing, LLC (“Ocwen”), Regional Trustee Service
27 Corporation (“Regional Trustee”), and New Start Home
28 Loans, Inc. ("New Start") (Doc. No. 25) ("FAC").

On January 16, 2013, the Court dismissed Plaintiffs'
3 claims, without leave to amend, against Deutsche Bank,
4 Morgan Stanley, MERS, Ocwen, and Regional Trustee.

Since then, Plaintiffs have not prosecuted their
7 claims against New Start.
On February 21, 2013, this
8 Court issued an Order to Show Cause ("OSC"), no later
9 than March 1, 2013, why the matter should not be
10 dismissed for failure to prosecute as to New Start.

12 Accordingly, the Court DISMISSES without prejudice
13 Plaintiffs' Complaint.
