The Court 24 accepts the findings and recommendation of the Magistrate Judge. 25 THEREFORE, IT IS HEREBY ORDERED that: 26 1. 27 /// 28 /// Defendants’ motion for summary judgment is granted. 1 2. Plaintiff’s unexhausted claim that Defendant Deveza violated his 2 constitutional rights by “tricking” him into withdrawing his 2010 grievance is 3 dismissed without prejudice. 4 3.
