Judgment (“Motion”). On June 21, 2016, after carefully considering the pleadings filed

in support of and in opposition to the Motion, the Court granted the Government’s

Motion in part as to Count I and denied the Motion as moot as to Count II.

Accordingly, IT IS HEREBY ORDERED, ADJUDGED, and DECREED that:

As to Count I of the First Amended Complaint, Plaintiff TIMOTHY

LEWIS WHITING is not entitled to damages against the United States

pursuant to 26 U.S.C. Section 7433.
