[PROPOSED] DEFAULT
JUDGMENT OF FORFEITURE
DATE: March 6, 2017
TIME: 10:00 a.m.
Before the Honorable Andre Birottѐ Jr.
United States District Judge
This action arose from the Verified Complaint for Forfeiture (“Complaint”)
25
filed herein on September 14, 2016. Notice of this action has been given in the
26
manner required by law. Neither potential claimants Mendoza, Spectra Enterprises
27
nor any other potential claimant has appeared by filing a Statement identifying his
28
1
1
or her rights or interests with this Court. Further, neither potential claimants
2
Mendoza, Spectra Enterprises nor any other potential claimant has filed an Answer
3
to the Complaint or otherwise defended his or her interest, if any, in the defendant
4
$211,000.00 in U.S. currency (“defendant currency”). Therefore, the Court deems
5
that potential claimants Mendoza, Spectra Enterprises and all other potential
6
claimants admit the allegations of the Complaint to be true. The Court further
7
finds that the allegations of the complaint establish that the defendant currency is
8
subject to forfeiture.
9
ACCORDINGLY, IT IS ORDERED, ADJUDGED AND DECREED that
10
all right, title, and interest of potential claimants Mendoza, Spectra Enterprises and
11
all other potential claimants in and to the defendant currency are condemned and
12
forfeited to the United States of America. The government shall dispose of the
13
defendant currency according to law.
