REMAND AS UNOPPOSED [11]

On December 12, 2016, Plaintiff filed a motion seeking to remand this class
2
action to the Superior Court of California, County of San Bernardino based on
3
Defendant’s failure to prove that the amount in controversy exceeds five million
4
dollars. (ECF No. 11.) After being granted a continuance, Defendant filed a notice of
5
non-opposition to the motion on January 9, 2017. (ECF Nos. 13–14.) Accordingly,
6
the Court GRANTS the motion and remands the case to the Superior Court for further
7
proceedings.
