ORDER GRANTING MOTION TO

On December 30, 2016, Plaintiff filed a motion seeking to remand this class
2
action to the Superior Court of California, County of San Bernardino based on
3
Defendant’s failure to prove that the amount in controversy exceeds five million
4
dollars. (ECF Nos. 16–17.) Defendant filed a notice of non-opposition to the motion
5
on January 13, 2017. (ECF No. 20.) Accordingly, the Court GRANTS the motion
6
and remands the case to the Superior Court for further proceedings.
