DEPOSITIONS
Defendants Ex Parte Application for Protective Order Postponing Depositions is Denied. In
addition to not qualifying for ex parte relief under Mission Power Engineering Co. v.
Continental Casualty Co., 883 F. Supp. 488 (C.D. Cal. 1995), the application appears to reflect
significant lack of communication between the parties. Plaintiff's counsel represents to the
Court that it has confirmed that depositions of these same defendants in the Batts case are not
proceeding at the same time as depositions in the Pringle case, and that the dates for the
Pringle depositions were cleared in advance with counsel for Defendants. Under all the
circumstances presented to the Court, this application offers no basis for relief.
