PLEASE TAKE NOTICE that, that, on December 19, 2011, at 10:00 A.M., or
3 as soon thereafter as counsel may be heard in the courtroom of the Honorable
4 Josephine Staton Tucker, United States District Judge, Central District of California,
5 located at the Santa Ana Courthouse, 411 West Fourth Street, Courtroom 10A,
6 Santa Ana, CA 92701-4516, Defendants Shapiro Bernstein & Co., Inc., David
7 Guetta and Frederic Riesterer (collectively “Defendants”), will and hereby do move
8 for an Order, pursuant to Rule 56 of the Federal Rules of Civil Procedure, granting
9 summary judgment in favor of Defendants and against Plaintiff Bryan Pringle.

This Motion is made pursuant to Rule 56 of the Federal Rules of Civil
11 Procedure, Local Rule 56, and this Court’s Initial Standing Order, and is based on
12 this Notice of Motion; Defendants’ Memorandum and Points of Authorities;

14 Declarations of Tal E. Dickstein, Paul Geluso, Erik Laykin, Lawrence Ferrara, Clark
15 Warner, David Guetta, Joachim Garraud, Frederic Riesterer, Jean-Charles Carre,
16 Thibaud Fouet, and Gary F. Roth, and all exhibits thereto; the Court file; any reply
17 Defendants may make; and any further papers or argument as may be presented to
18 the Court prior to or at the hearing on this motion, or subsequent thereto as directed
19 by the Court.
