Josephine Staton Tucker Courtroom 10A STIPULATION REQUESTING COURT TO CONTINUE HEARING DATE FOR DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT 24 25 26 27 28 NY990919.1 217131-10001 STIPULATION 1 This Stipulation is made by and among counsel for all parties to this action, 2 Plaintiff Bryan Pringle (“Plaintiff”), David Guetta, Frederic Riesterer and Shapiro, 3 Bernstein & Co., Inc. (together the “Guetta Defendants”), William Adams, Allan 4 Pineda, Jaime Gomez, and Stacy Ferguson p/k/a Fergie, all individually and 5 collectively known as the music group The Black Eyed Peas, will.i.am. music llc, 6 Tab Magnetic Publishing, Headphone Junkie Publishing, LLC, Cherry River Music 7 Co., Jeepney Music, Inc., EMI April Music (together the “Adams Defendants”), 8 UMG Recordings, Inc. and Interscope Records (together the “UMG Defendants”), 9 (Plaintiff, the Guetta Defendants, the Adams Defendants and the UMG Defendants 10 are collectively referred to as the “Parties”), and is made with reference to the 11 following facts: 12 1. WHEREAS, on November 17, 2011, the Guetta Defendants filed a 13 motion for summary judgment (Doc. 159-172) (hereafter “Defendants’ MSJ”) and 14 set a hearing date of December 19, 2011, which was the last date for law and motion 15 hearings under the Court’s February 24, 2011 Case Management Order (Doc. 115). 16 2. WHEREAS, on November 21, 2011, the Parties submitted a Stipulation 17 and Proposed Order requesting, among other things, that the Court continue the 18 hearing date for Defendants’ MSJ from December 19, 2011 to February 20, 2012. 19 3. WHEREAS, by Order dated November 22, 2011 (Doc. 179), the Court 20 granted in part and denied in part the Parties’ Stipulation and Proposed Order, and 21 set the hearing date on Defendants’ MSJ for January 23, 2012. 22 4. WHEREAS, the Guetta Defendants’ lead trial counsel, Barry I. 23 Slotnick, is scheduled to begin a jury trial on January 23, 2012 in the United States 24 District Court for the Southern District of New York, in which Mr. Slotnick is also 25 lead trial counsel. That trial is expected to last approximately five days. 26 27 28 NY990919.1 217131-10001 STIPULATION 1 1 5. WHEREAS, in order to accommodate this scheduling conflict, the 2 Guetta Defendants request a one-week adjournment of the hearing date on the 3 Defendants’ MSJ, from January 23, 2012 to January 30, 2012. 4 6. WHEREAS, Plaintiff, the Adams Defendants and the UMG Defendants 5 consent to this requested adjournment. 6 7. WHEREAS, the requested adjournment will not affect any other 7 deadlines in this action, including but not limited to the briefing schedule for 8 Defendants’ MSJ and the pre-trial and trial dates. 9 8. BASED UPON THE FOREGOING FACTS, IT IS HEREBY 10 STIPULATED AND REQUESTED by and between the Parties, through their 11 respective counsel, subject to the Court’s approval, that the Court’s November 22, 12 2011 Order be modified to continue the hearing date on Defendants’ MSJ from 13 January 23, 2012 to January 30, 2012, at 10:00 am. 14 15 Dated: December 8, 2011 16 17 Donald A.
