DISMISSING COMPLAINT WITHOUT
PREJUDICE

On October 31, 2012, Plaintiff Nelson Velasco filed a
19
complaint against Defendants Homewide Lending Corp.
20
("Homewide"), Aurora Loans Services LLC ("Aurora"),
21
Nationstar Mortgage LLC ("Nationstar"), Mortgage
22
Electronic Registration Systems, Inc. ("MERS"), and
23
fictitious entities.
(Compl., Doc. No. 1.)
On January
24
31, 2013, the Court granted Nationstar, Aurora, and MERS'
25
motion to dismiss the Complaint because Plaintiff failed
26
to oppose the motion.
(Doc. No. 14.)
In accordance with
27
that order, Defendants Nationstar, Aurora, and MERS were
28
1 dismissed from the Complaint without prejudice on January
2 31, 2013.

(Doc. No. 15.)
On March 11, 2013, the Court issued an order to show
4 cause why the case should not be dismissed as to
5 Defendant Homewide because Plaintiff failed to file a
6 proof of service.
(Doc. No. 17.)
The Court put
7 Plaintiff on notice that failure to respond to the order
8 would be deemed consent to the dismissal of the action.
9 (Id.)
As of the date of this Order, Plaintiff has not
10 responded to the order to show cause, nor has he filed
11 the required proof of service.

Accordingly, the Court DISMISSES Plaintiff's
13 Complaint WITHOUT PREJUDICE.
The Court orders that such
14 judgment be entered.
