Case No. SACV 14-00833 JLS (JCGx) CONSENT JUDGMENT 1 Plaintiffs, having filed an action for copyright infringement against Defendant 2 R.S.A. Entertainment, Inc. (“Defendant”), now request entry of this Consent Judgment. 3 For the reasons set forth below, IT IS ORDERED, ADJUDGED AND DECREED 4 THAT: 5 1. Plaintiff Broadcast Music, Inc. licenses the right of public performance, and 6 the other Plaintiffs own the copyrights, in the following musical compositions: 7 a. Californication 8 b. Down On The Corner 9 c. Folsom Prison a/k/a Folsom Prison Blues 10 d. Have You Ever Seen The Rain a/k/a Have You Ever Seen The Rain? 11 e. Homeward Bound 12 f. Lodi 13 g. Margaritaville 14 h. Paint It Black 15 i. Under The Bridge 16 j. Blue On Black 17 2. Defendant has willfully infringed the copyrights in the musical works listed in 18 Paragraph 1 above. 19 3. Defendant is hereby permanently enjoined from causing any unlicensed 20 public performances of any musical works licensed by Broadcast Music, Inc. 21 4. Defendant shall pay the Plaintiffs damages in the amount of $17,602.00, 22 which represents an agreed to amount of $22,000 minus $4,398, which represents the 23 amount that has already been paid by Defendant pursuant to paragraph 1 of the Settlement 24 Agreement between the parties. Therefore, judgment is hereby entered in favor of Plaintiffs 25 and against Defendant in the amount of $17,602, plus interest from the date this consent 26 judgment is entered. 27 /// 28 /// 1 1 5.
