Pursuant to 28 U.S.C. § 636, the Court has reviewed the Petition, the Magistrate Judge’s

Amended Report and Recommendation, Petitioner’s Objections and the remaining record, and

19

has made a de novo determination. See Fed. R. Civ. P. 72(b); 28 U.S.C. § 636(b)(1); United

20

States v. Reyna-Tapia, 328 F.3d 1114, 1121 (9th Cir. 2003).

In his Objections, Petitioner simply reargues the merits of the Petition. The Court,

22

therefore, overrules the Objections for the reasons stated in the Amended Report and

23

Recommendation.

Accordingly, IT IS ORDERED THAT:

The Amended Report and Recommendation is approved and accepted;

Judgment be entered denying the Petition and dismissing this action with
