Pursuant to the Stipulation for Entry of Judgment between plaintiff Michael F.

2 O’Neill and defendant Matthew R. Smith, and good cause appearing therefore, it is hereby
3 ordered, adjudged and decreed that:

1.

Plaintiff Michael F. O’Neill shall have judgment against defendant Matthew

5 R. Smith in the amount of $306,820.73; and
6

2.

Plaintiff Michael F. O’Neill shall have the right, but not the obligation, to sell

7 the real property known as El Farito Unit #201, located at Calle Hidalgo, Lot 1D, Emiliano
8 Zapata, Nayarit, Mexico (the “Condo”) to satisfy the amount owing from Matthew R. Smith
9 to Michael F. O’Neill pursuant to this judgment, with any excess proceeds (i.e., any
10 proceeds that remain after payment to Michael F. O’Neill of all amounts due pursuant to
11 this judgment) paid to Matthew R. Smith, and that, Matthew R. Smith shall, upon demand,
12 execute any and all documents necessary to enable Michael F. O’Neill to sell the Condo.

The court clerk is ordered to enter this judgment.
