Plaintiff John E. James ("Plaintiff") is a state prisoner proceeding pro se and in forma pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. This action is currently set for jury trial commencing February 2, 2009. Due to the Court's heavy calendar, which includes a three week trial that has been confirmed to commence on January 26, 2009 before the undersigned, the trial in this case, James v.
