Plaintiff is a prisoner proceeding pro se in a civil rights action pursuant to 42 U.S.C.

§ 1983. On December 1, 2008, Defendants Beeler, Adams, Wan, and Hansen filed a motion for

17

summary judgment and various supporting documents. (Docs. 77-85.) Various exhibit pages

18

are referenced which were not filed with the Court.

Accordingly, IT IS HEREBY ORDERED that:

Within ten (10) days of the date of service of this order, Defendants are directed to:

21

(1)

Submit all exhibit pages referenced in their motion with numerical pagination
below “AG000503”;

23

(2)

Submit a copy of the proof(s) of service showing that all such exhibit pages have

24

been served on Plaintiff and under what circumstances (i.e., whether at the time

25

of filing of the motion for summary judgment, in discovery, or in initial

26

disclosures); and

submit a statement detailing Defendants’ position, and any supporting authority,

as to whether Plaintiff had adequate notice to respond to these documents in his

opposition.
