Case No.: 1:05-cv-01625-SAB (PC) ORDER SETTING SETTLEMENT CONFERENCE ALEXANDER, et al., 14 Defendants. 15 The jury trial in this matter concluded on October 3, 2016. Plaintiff is represented by 16 17 Christina Aryafar, Kenneth Lee, and Max Selfridge. The parties, by and through their counsel of 18 record, have agreed to participate in a settlement conference to attempt to resolve all of Plaintiff’s 19 pending cases. Therefore, this case will be referred to Magistrate Judge Kendall J. Newman to 20 conduct a settlement conference at the U.S. District Court, 501 I Street, Sacramento, California 21 95814 in Courtroom #25 on March 28, 2017 at 9:00 a.m. 22 A separate order and writ of habeas corpus ad testificandum will issue in due course. 23 In accordance with the above, IT IS HEREBY ORDERED that: 24 1. This case is set for a settlement conference before Magistrate Judge Kendall J. 25 Newman on March 28, 2017 at 9:00 a.m. at the U. S. District Court, 501 I Street, 26 Sacramento, California 95814 in Courtroom #25. 27 28 /// 1 2. A representative with full and unlimited authority to negotiate and enter into a binding 1 settlement on the defendants’ behalf shall attend in person. 2 3. Those in attendance must be prepared to discuss the claims, defenses and damages. 3 4 The failure of any counsel, party or authorized person subject to this order to appear in 5 person may result in the imposition of sanctions. In addition, the conference will not 6 proceed and will be reset to another date. 7 4. The parties are directed to exchange non-confidential settlement statements seven days 8 prior to the settlement conference. These statements shall simultaneously be delivered 9 to the court using the following email address: kjnorders@caed.uscourts.gov. If a 10 party desires to share additional confidential information with the court, they may do 11 so pursuant to the provisions of Local Rule 270(d) and (e). 5. The confidential settlement statement shall be no longer than five pages in length, 12 typed or neatly printed, and include the following: 13 14 a. A brief statement of the facts of the case. 15 b. A brief statement of the claims and defenses, i.e., statutory or other grounds 16 upon which the claims are founded; a forthright evaluation of the parties= 17 likelihood of prevailing on the claims and defenses; and a description of the 18 major issues in dispute. 19 c. A summary of the proceedings to date. 20 d. An estimate of the cost and time to be expended for further discovery, pretrial, and trial. 21 22 e. The relief sought. 23 f. The party=s position on settlement, including present demands and offers and a history of past settlement discussions, offers, and demands. 24 25 /// 26 /// 27 /// 28 2 g.
