On April 4, 2013, this Court denied plaintiff’s motion to increase the fees and costs previously
19
awarded by the Equal Employment Opportunity Commission. With regard to costs, the Court found that
20
plaintiff was paid more than he was entitled and gave defendant seven (7) calendar days to seek
21
reimbursement. The time for seeking reimbursement has expired and the Court has not heard from
22
defendant. Accordingly, this Court DIRECTS the clerk to enter judgment in favor of defendant Donald
23
C. Winter, Secretary of the Department of the Navy and against plaintiff Ronald L. Porter and to close
24
this action.
