Having reviewed the R e p o rt and Recommendation and having independently reviewed the record in this c a s e , the Court finds that the Report and Recommendation reflects an appropriate a p p lic a tio n of the law to the facts of this case. Therefore, the Court adopts the R e p o rt and Recommendation in full. ORDER ADOPTING REPORT AND RECOMMENDATION - 1 ORDER N O W THEREFORE IT IS HEREBY ORDERED that the Report and R e c o mme nd a tio n (Docket No. 43) is ADOPTED in full. IT IS FURTHER HEREBY ORDERED that Defendant's Motion to Revoke P la intiff' s in Forma Pauperis Status (Docket No. 40) is GRANTED, and Plaintiff's in Forma Pauperis Status is REVOKED. IT IS FURTHER HEREBY ORDERED that Plaintiff shall have thirty (30) d a ys from the date of this Order to pay the full filing fee, and thereafter, thirty (30) a d d itio na l days to reimburse the U.S. Marshal Service for the costs of service, if a ny. Failure to pay these fees and costs within this time frame will result in d is mis s a l of Plaintiff's case without prejudice under Rule 41 without further notice to Plaintiff.
